In this case, we review a magistrates pretrial order suppressing evidence in a misdemeanor prosecution for driving while under the influence (DUI). The order was reversed upon appeal to the district court, precipitating this further appeal by Evan Jones, the driver charged with the offense. Like the district court, we also conclude the magistrate erred in ordering suppression of the evidence. Consequently, we affirm the district courts appellate decision remanding this case for further proceedings.
