Mauro entered a guilty plea pursuant to a negotiated plea agreement. The agreement provided that in exchange for a guilty plea to delivery of a controlled substance, the prosecution, at the time of sentencing, would dismiss three misdemeanor charges and would also limit itself to recommending no more than a 120-day retained jurisdiction, rely only on the presentence report, and provide no aggravating witnesses.
